My Vet ‘Spin To Win’ Promo - Terms and Conditions
The Promoter
1.
The promoter is Bayer New Zealand Limited (company no. 17012) of 3 Argus Place, Hillcrest, Auckland 0627, New Zealand (Promoter).
Conditions of entry
2.
Information on how to enter the My Vet ‘Spin to Win’ promotion (Promotion) and on the prizes forms part of these terms and conditions. Participation in the Promotion is deemed acceptance of these and any other applicable terms and conditions (together the Terms and Conditions). Any entry not complying with the Terms and Conditions is invalid.
3.
Entry into the Promotion is open to New Zealand residents who are aged 18 years or over. Employees and directors of the Promoter and the immediate families of employees and directors of the Promoter are not eligible to enter.
How to enter
4.
To enter, each participant must:
a.
Purchase at least one of the following Bayer products from www.myvet.co.nz: Seresto® Flea Collar for Cats, Seresto® Flea Collar for Dogs Over 8kg, Seresto® Flea Collarfor Dogs Under 8kg, Advocate Flea and Worm treatment for Cats Over 4kg, Advocate Flea and Worm treatment for Cats and Kittens Less Than 4kg, Advocate Flea and Worm treatment for Dogs and Puppies Less Than 4kg, Advocate Flea and Worm treatment for Dogs 4-10kg, Advocate Flea and Worm treatment for Dogs 10-25kg, Advocate Flea and Worm treatment for Dogs Over 25kg, Advantage® Flea Treatment for Cats and Rabbits Over 4kg, Advantage® Flea Treatment for Cats, Kittens and Rabbits Less Than 4kg, Advantage® Flea Treatment for Small Dogs and Puppies Less Than 4kg, Advantage® Flea Treatment for Dogs 4-10kg,Advantage® Flea Treatment for Dogs 10-25kg or Advantage® Flea Treatment for Dogs Over 25kg (each a Qualifying Product).
b.
Click through the Promotion entry page link from the MyVet site to go to the Promoter’s website: www.bayeranimal.co.nz/en/promotions/my-vet-promotion/ and click into the ‘Spin to Win’ promotion.
c.
Complete the online Promotion entry form including entering the participant’s My Vet order number from their emailed receipt for the Qualifying Product purchased, Qualifying Product purchased, date of purchase and personal details (name, email and phone number).
5.
Every participant has a maximum of one opportunity to enter the ‘Spin to Win’ for each single transaction (regardless of quantity of Qualifying Product purchased in that single transaction/same order). As such, each entry must have a unique and valid My Vet order number.
a.
The participant may ‘Spin to Win’ the purchase price for a maximum of one Qualifying Product purchased per entry. Where multiple Qualifying Products were purchased with the same My Vet order number (ie as part of one transaction), where the participant is a winning participant they will receive a refund for the highest value Qualifying Product on that order (ie in that transaction).
b.
In the case that a participant has a valid order number and has purchased a Qualifying Product, but has entered the incorrect sku code into the entry form, the refund will be for the correct Qualifying Product purchased within the My Vet Order number.
c.
Each participant can enter and ‘Spin to Win’ multiple times where they have separate transactions, provided that each entry has a unique My Vet order number (ie is a separate transaction) and includes a Qualifying Product.
6.
The Promoter accepts no responsibility for any entries that are incomplete, illegible, corrupted or fail to reach the Promoter for any reason by the relevant Closing Time and Date.
7.
Each of the Promoter and My Vet reserve the right, at any time, to verify the validity of entries and the eligibility of the participant (including a participant’s identity, age, place of residence and/or transaction details). The Promoter may (in its sole discretion) disqualify any participant who submits an entry that is not made strictly in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Promotion
8.
The Promotion commences at 12.01am on 1st December 2019 and closes at 11.59pm on 31st January 2020 (Closing Time and Date). Entries must be completed and received by Promoter by the Closing Time and Date.
9.
Once a participant has completed the Entry Form correctly, they click the ‘Spin to Win’ button to go through to the Spinning Wheel. This will give them one (1) opportunity to ‘spin to win’ a prize of a refund on their Qualify Product by spinning the wheel via a website button. Each eligible spin gives the participant a randomised one in ten chance of winning the cost of their Qualifying Product purchase back.
10.
Participants will receive a ‘Congratulations’ or ‘Sorry you are not a winner’ message online immediately after spinning.
11.
A winner’s list will be sent to My Vet weekly, with all prizes of refunds being automatically paid within seven working days of the draw. All winners of refunds will also be notified that their refund has been made by the Promoter (or their agent) within seven business days via email, using the contact details on the online entry form.
12.
Refunds will be made to the participant’s credit card as used for the My Vet order. In the case that a winning participant paid for their order using internet banking, the refund will be made to that bank account.
13.
If a refund is unable to be made to the credit card or account used for the order, My Vet will attempt to contact the winner for an alternative account to refund to. If the winner cannot be contacted within 15 business days following the prize draw, the prize (refund) will be forfeited. The Promoter is not responsible if the prize-winner cannot be contacted within 15 business days after the draw.
14.
If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the control of the Promoter, the Promoter reserves the right to the fullest extent permitted by law to (a) disqualify any participant; or (b) modify, suspend, terminate or cancel the Promotion, as it deems appropriate.
Refund Prizes
15.
Every participant with a valid entry has a random one-in-ten chance to win a prize.
16.
Each prize is a refund for the purchase price of the Qualifying Product purchased on their corresponding My Vet order.
17.
Neither the prize nor any surprise gift provided by the Promoter as part of the Promotion is not exchangeable, transferable, negotiable or redeemable for cash.
18.
The Promoter’s decision regarding prize winners shall be final and no correspondence will be entered into.
Personal Information
19.
The Promoter collects personal information in order to conduct this Promotion and may, for this purpose, disclose such information to third parties including, but not limited to, agents used in this Promotion, prize suppliers and, if required, New Zealand regulatory authorities. Entry is conditional on providing this information. By entering this Promotion the participant agrees that the Promoter may use the information for purpsoes of conducting the promotion. The Promoter will otherwise use and handle personal information as set out in its privacy policy, which can be accessed on www.bayer.co.nz. As the Promoter is a global organization, personal information may be stored overseas. Participants may request to access, update or correct any personal information held about them by the Promoter at any time by contacting the Promoter’s Privacy Officer (details of which can be found on the Promoter’s privacy policy). Any complaints regarding treatment of a participant’s personal information by the Promoter should also be directed to the Promoter’s privacy officer. All entries become the property of the Promoter.
Limitation of liability
20.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability for any loss, damage or personal injury whatsoever (including but not limited to loss of opportunity and loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where such liability may arise out of the following:
(a)
any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(b)
any theft, unauthorised access or third party interference;
(c)
any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or
(d)
any tax liability incurred by a prize-winner or participant.
